OLD LYME PLANNING COMMISSION
PUBLIC HEARING & REGULAR MEETING
AUGUST 14, 2008


PRESENT WERE:   Harold Thompson, Chris Kerr, Sean Mulligan and Alternate Nancy Strohla seated for Connie Kastelowitz.  


PUBLIC HEARING

SUBDIVISION – DAVID A. BLACKBURN – 14 BLACKWELL LANE – 2 LOTS

Fern Tremblay, Professional Engineer, with Angus McDonald & Gary Sharpe Associates presented the proposal on behalf of the applicant, David Blackburn. Tremblay reported that the property is located at the southern end of Blackwell Lane.   He noted the proposal is for a two-lot subdivision on approximately 14 acres.    He noted Lot #1 would be 2.46 acres and Lot #2 would consist of 12.2 acres and extend to the rear of the property and 8.6 acres would have a conservation easement deeded to the Town of Old Lyme.  

Tremblay stated that the plans have been revised  to address the comments sent to the commission  from both  Attorney Edward M. Cassella in his  letter dated August 12, 2008 and Thomas E. Metcalf in his letter dated August 9, 2008.  Tremblay noted that the only outstanding item to be addressed is the easements due to the fact that Mr. Blackburn is currently out of town.  

Tremblay stated as part of the application he has requested three waivers.

First Waiver - The applicant has requested  waiver of the requirement to provide topography in the conservation easement area because is there is no development proposed in this area.

Second Waiver - The applicant has requested a waiver of the requirement to provide a cul-de-sac and substituted a T-shape turnaround to serve the two houses due to the fact that the cul-de-sac would take a larger portion of the land away from the site

Third Waiver – The applicant has requested that curbing be waived on the site.   He noted there is currently no curbing on Blackwell Lane.

Tremblay stated that Mr. Metcalf  had noted in his letter to the commission that Lot #2 is considered to be a rear lot and therefore the setbacks need to be increased  by 25 percent and shown on the plan.   Tremblay indicated this revision has been made and shown on

Tremblay stated there is no activity proposed in the regulated wetland area.  He also noted the plans were reviewed by Ann Brown and it was determined that there was no jurisdiction over this application by the Inland/Wetlands Commission.

Tremblay also submitted construction cost estimates for the bonding of the project that have been reviewed by Mr. Metcalf and resubmitted with the appropriate changes as requested.  He also noted he has provided a copy of the plans to the Town Assessor’s office so house numbering could be provided.

Thompson asked if iron and concrete monuments would be provided as recommended in Metcalf’s letter.  Tremblay indicated that was correct.   

Thompson also asked if the two easements would be addressed when Mr. Blackburn returned.  Tremblay indicated that was correct.

Thompson asked about the waiver of the cul-de-sac.  Tremblay stated this would take up a very large area on the site and he has achieved the required distances with the T-shape turnaround that have been reviewed by the Old Lyme Fire Department.  Thompson read the letter into the record to the commission from Fire Chief Dave Jewett indicating he is satisfied with the proposal.

Thompson reviewed the bonding with the applicant.  

Lars Vigen – Reviewed the frontage requirements with the applicant shown on the proposed subdivision.  Vigen also asked Tremblay to show on the proposed plan the distances to his property line from the proposed driveway into the site.   Vigen also discussed the open space requirements for a subdivision with the commission.  

Harold Thompson made a motion to close the public hearing.  Chris Kerr seconded the motion.  The motion passed unanimously.

AMEND THE AGENDA

Harold Thompson made a motion to amend the agenda to include discussion and possible decision on the Blackburn Subdivision.   Nancy Strohla seconded the motion.  The motion passed unanimously.

SUBDIVISION – ENOK PEDERSEN – REQUEST FOR AN EXTENSION OF 180 DAYS FOR FILING THE MYLARS

Harold Thompson made a motion to grant the extension.  Chris Kerr seconded the motion.  The motion passed unanimously.

DISCUSSION AND POSSIBLE DECISION ON THE BLACKBURN SUBDIVSION.

Harold Thompson made a motion to approve the subdivision with the following conditions.

1.      Resolution of the drainage easement and conservation easement be done and completed as outlined in Attorney Cassella’s letter and approved by Cassella prior to signing the mylars.
2.      The three waivers are granted as proposed by the applicant.
3.      The bond be submitted and approved by Mr. Metcalf.

Chris Kerr seconded the motion.  The motion passed unanimously.
